These Terms of Service (“Terms”) govern your access to and use of Prosellers and related websites, applications, and services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

Eligibility and accounts

You must be able to form a binding contract in your jurisdiction and meet any minimum age requirements. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use.

Marketplace nature

Prosellers provides a platform where independent buyers and sellers may transact. We may facilitate listings, messaging, or payments as described in the product, but unless expressly stated, we are not the seller of items offered by third parties. Sellers are responsible for their listings, descriptions, delivery, and compliance with applicable laws.

Acceptable use

You agree not to:

  • Violate any law or third-party rights;
  • Use the Services to distribute malware, spam, or deceptive content;
  • Attempt to gain unauthorized access to systems, accounts, or data;
  • Interfere with or disrupt the Services or other users’ use of them;
  • Circumvent security, fees, or limitations we put in place.

We may investigate and take action — including suspension or termination — if we believe you have violated these Terms or pose a risk to the platform or others.

Payments and fees

Fees, payment methods, refunds, and dispute processes are described at checkout or in separate policies where applicable. You authorize us and our payment partners to charge amounts you owe in accordance with those terms. Taxes may apply based on your location and applicable law.

Intellectual property

The Services, including branding, software, and content we provide, are owned by us or our licensors and protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the Services for their intended purpose. You may not copy, modify, or reverse engineer our Services except as permitted by law.

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, AND EMPLOYEES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR ONE HUNDRED DOLLARS (USD $100), EXCEPT WHERE PROHIBITED BY LAW.

Suspension and termination

We may suspend or terminate your access to the Services at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users or the platform. You may stop using the Services at any time. Provisions that by their nature should survive will survive termination (including disclaimers, limitations of liability, and governing law).

Governing law

These Terms are governed by the laws applicable in the jurisdiction we designate for Prosellers, without regard to conflict-of-law rules. Courts in that jurisdiction shall have exclusive jurisdiction over disputes, subject to mandatory consumer protections in your country of residence where they cannot be waived.

Changes

We may modify these Terms from time to time. We will post the updated Terms on this page and update the “Last updated” date. Material changes may be communicated through the Services or by email where appropriate. Continued use after the effective date constitutes acceptance of the revised Terms where permitted by law.
